These Terms govern use of isitmyname.com, membership features, member content, community features, Public Recordings, and related tools. Please read them before using the site or creating an account.
1. Acceptance of these Terms
By accessing or using isitmyname.com, creating an account, making a membership contribution, using member tools, participating in the community, or publishing a Public Recording, you agree to these Terms & Conditions and the Privacy Policy.
If you do not agree, do not use the applicable service or feature. Certain features may also display additional terms or notices at the point of use; those additional terms form part of your agreement for that feature.
2. Educational and informational purpose
IS IT MY NAME provides research, education, source material, personal experiences, document examples, templates, podcasts, community discussion, documentation tools, Public Recordings, and related resources for independent study and discernment.
Examples, member experiences, testimonials, documents, corrections, responses, and outcomes are individual examples and are not guarantees that another person will obtain the same result.
3. Eligibility, accounts, and security
Membership services are intended for adults who are at least 18 years old. You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and all activity conducted through your account.
You may not share access credentials in a way that defeats membership limits, security controls, or access restrictions. Notify us promptly through the contact method published on isitmyname.com if you believe your account has been compromised.
4. Membership contributions, continuing access, and cancellation
Membership offers and contribution amounts are shown at checkout and may change for future members. The terms shown at checkout at the time of your transaction control that transaction.
Current Founding Member structure
- The current Founding Member prelaunch contribution is $199 USD as shown on the sales page and checkout.
- The first 3 months of continuing community access are included.
- After the included period, continuing community access is currently offered to Founding Members at $5 USD per month while active, subject to the terms presented at checkout.
- If continuing community access is cancelled, future recurring contributions stop according to the cancellation timing shown in the account/billing area. The core access specifically described as lifetime access remains available, subject to these Terms.
- An accessible Founding option may be offered as four monthly $50 contributions ($200 total). Community access begins after the first successful contribution; Knowledge Base and Document Templates unlock after the full Founding contribution is completed. If the account provides an early payoff option, the remaining balance may be completed early.
Taxes, transaction charges, currency conversion, or other charges imposed by a processor, financial institution, or law may apply where applicable.
Refunds, if any, are governed by any refund terms displayed at checkout and by rights that cannot lawfully be excluded. If a contribution is refunded, reversed, charged back, or remains unpaid, associated membership roles, access, or benefits may be suspended or removed.
5. Member content and responsibility
You retain ownership of original material you submit, subject to any rights held by third parties. By uploading or submitting material, you grant IS IT MY NAME a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and otherwise process that material as reasonably necessary to provide the feature you selected.
You are solely responsible for the accuracy, lawfulness, relevance, and content of material you upload or publish, including documents, images, names, dates, locations, allegations, descriptions, links, correspondence, attachments, and information about other people.
You represent that you have the rights, authority, permissions, or other lawful basis necessary to submit and use the material in the manner you select.
6. Public Recordings / Lawful Public Recordings
Public Recordings are intentionally public. This feature is designed to create a publicly viewable record. It is materially different from a private member workspace, private upload, or private community discussion.
Publicly posted material may be viewed worldwide and may be copied, downloaded, quoted, indexed by search engines, cached, archived, screenshotted, linked, redistributed, or otherwise retained by members of the public or third parties. It may therefore become public knowledge beyond the technical control of IS IT MY NAME.
IS IT MY NAME cannot control or guarantee the privacy, confidentiality, deletion, recall, or downstream use of information after a member intentionally publishes it to a Public Recording. Removing a posting from our own systems, if removal is available or appropriate, cannot guarantee removal of copies already downloaded, shared, indexed, cached, archived, quoted, or otherwise retained by others.
Your responsibility before publishing
Before publishing, review every field and attachment. Remove or redact information you do not intend to make public. Exercise particular care with financial account details, government identifiers, authentication information, passwords, private contact details, information about minors, health information, and sensitive information about third parties.
If a Public Recording contains information about another person, you are responsible for determining whether you have authority or another lawful basis to publish it. IS IT MY NAME does not make that determination for you and does not assume responsibility for a member’s decision to publish third-party information.
Moderation and preservation
IS IT MY NAME is not required to pre-screen or monitor every Public Recording. We may restrict, remove, preserve, or refuse content where reasonably necessary to address security, unlawful content, infringement, abuse, technical integrity, a valid legal requirement, or violation of these Terms. Evidence, audit, security, backup, or transaction records may be retained where reasonably necessary even if public display is later removed.
7. Lawful Service of Notice and evidence tools
Where the site provides notice-transmission, evidence, timestamping, document-hashing, tracking, delivery, access, reply, archive, or certificate features, those tools are provided to help users document what occurred technically.
No feature guarantees that a recipient read, understood, accepted, or legally received a notice, that a transmission satisfies any particular service requirement, or that a generated record or certificate will be accepted as evidence by any court, tribunal, agency, institution, or other decision-maker. You are responsible for determining the requirements that apply to your circumstances.
8. Community, live sessions, Q&A, and Telegram
Community discussions, livestreams, live podcasts, Q&A sessions, webinars, interviews, voice/video rooms, Telegram spaces, recordings, and similar events are educational community features. Other members are independent participants, not agents or professional advisers of IS IT MY NAME. Their statements and experiences are their own.
Participation is consent to recording and content use
This consent includes, where applicable, your display name, username, profile image, voice, likeness, video image, chat messages, questions, answers, comments, screen-shared material, and other contributions you voluntarily make during the session.
You authorize IS IT MY NAME to record, reproduce, edit, excerpt, transcribe, caption, translate, adapt, combine with other material, publish, display, distribute, archive, rebroadcast, and otherwise use that participation in whole or in part for the members portal, Educational Series, recordings, podcasts, clips, websites, Public Recordings where appropriate, social media, promotional material, educational material, and other IS IT MY NAME content.
Unless IS IT MY NAME separately agrees otherwise in writing, no additional approval, royalty, fee, or compensation is required for an authorized use described above. If you do not want a contribution recorded or potentially used in member or public content, do not make that contribution during a recorded or publishable session. A session expressly identified by IS IT MY NAME as private or off-record may be subject to different terms stated for that session.
Third-party platforms
When you use Telegram or another third-party community or livestream service, that service’s own terms and privacy practices also apply. Do not treat a third-party community channel as a secure place for highly sensitive information.
9. Prohibited conduct
You may not use the site to violate applicable law, impersonate another person, obtain unauthorized access, distribute malware, interfere with site security, harass or threaten others, intentionally publish credentials or highly sensitive information for abusive purposes, infringe intellectual-property rights, submit material you have no right to use, or misuse the service to facilitate fraud or deception.
You may not scrape, mass-download, reverse engineer, republish, resell, or systematically reproduce protected member materials except as expressly allowed by the site or by applicable law.
10. Intellectual property
Unless otherwise stated, the site’s original branding, design, guides, educational materials, templates, member-library organization, graphics, recordings, software, and other original content are owned by or licensed to IS IT MY NAME and are protected by applicable intellectual-property laws.
Livestreams, Q&A, recordings, and participant contributions
IS IT MY NAME owns the recordings and productions it creates, including its livestream recordings, podcasts, edited videos, audio recordings, transcripts, captions, graphics, compilations, excerpts, clips, and derivative productions created from IS IT MY NAME sessions.
To the extent that copyright or other intellectual-property rights in a contribution you voluntarily make during an IS IT MY NAME livestream, Q&A, podcast, webinar, interview, Telegram event, or other recorded session would otherwise vest in you, you agree, to the extent permitted by applicable law, to assign to IS IT MY NAME all right, title, and interest necessary for IS IT MY NAME to own and exploit that contribution as incorporated into the session recording or resulting content.
Where an assignment is not legally effective or additional rights are required, you grant IS IT MY NAME a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to record, reproduce, edit, adapt, excerpt, translate, transcribe, caption, publish, publicly display, publicly perform, distribute, communicate, archive, promote, create derivative works from, and otherwise use the contribution in member-only or public IS IT MY NAME content, in any media now known or later developed.
To the extent permitted by applicable law, you waive and agree not to assert moral rights or similar rights in those session contributions against IS IT MY NAME or its authorized users. This paragraph does not transfer ownership of pre-existing material you created outside the session merely because you refer to it; however, if you intentionally submit or display pre-existing material during a session, you grant the rights reasonably necessary to include that material in the authorized recording and uses described above.
Member use of IS IT MY NAME materials
Your membership grants you a personal, non-exclusive, non-transferable right to use member materials for your own learning, documentation, and permitted personal use. It does not transfer ownership or authorize resale, public redistribution, sublicensing, or creation of a competing commercial library from the materials.
11. Third-party services and links
The site may rely on third-party services for hosting, email, checkout/transaction processing, messaging, communications, storage, authentication, security, or other infrastructure, and may link to external websites. We do not control the content, availability, security, or privacy practices of independent third parties.
12. Availability, development, and changes to features
The member system is an evolving service. Features, templates, recordings, Public Recording tools, community functions, integrations, schedules, and content may be added, improved, replaced, reorganized, or discontinued. We do not promise uninterrupted availability or that every feature will remain technically unchanged.
Any specific lifetime-access commitment applies to the core access described in the applicable offer, not to a guarantee that every individual feature, integration, third-party service, or community benefit will exist forever in its current form.
13. Disclaimers and no guarantee of outcomes
The site and materials are provided on an “as available” and “as is” basis to the fullest extent permitted by applicable law. We do not warrant that information is complete, error-free, universally applicable, or suitable for every purpose.
We do not guarantee any legal, lawful, administrative, credit, financial, court, government, institutional, commercial, or personal outcome. Testimonials and member examples describe individual experiences only.
14. Limitation of liability
To the fullest extent permitted by applicable law, IS IT MY NAME, its operators, contributors, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, loss of data, loss of opportunity, or decisions made in reliance on site content.
Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.
15. Your responsibility for claims arising from your content or conduct
To the extent permitted by law, you agree to be responsible for claims, losses, or costs arising from your unlawful use of the service, your violation of these Terms, your infringement of another person’s rights, or material you upload or intentionally publish without the required rights or authority.
16. Suspension and termination
We may suspend or restrict access where reasonably necessary to protect the service, users, security, evidence integrity, third-party rights, or legal compliance, or where an account materially violates these Terms.
Termination or cancellation does not erase obligations or rights that by their nature should survive, including intellectual-property provisions, public-publication consequences, evidence preservation, disclaimers, and limitations of liability.
17. Electronic communications
By creating an account or using the service, you agree that operational communications may be sent electronically, including account, security, contribution, confirmation, membership, service, and policy notices. Marketing communications, where used, may be unsubscribed from using the method provided in the message.
18. Changes to these Terms
We may update these Terms as the service develops or as legal, security, or operational requirements change. The effective date at the top of this page identifies the current version. Material changes may also be communicated through the site, account area, or email where appropriate.
19. General terms
If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms do not limit rights that applicable consumer or privacy law makes mandatory. Questions about which law or forum applies to a particular dispute will be determined under the applicable law and facts of that dispute.
